Gemteq Executive Privacy Policy

Gemteq Executive (ABN 71 268 674 697) is a partnership between GW International Pty Ltd (ABN 17 096 937 067) and Mulgna International Pty Ltd (ABN 97 096 937 469) (Gemteq) providing tailored recruitment solutions to select clientele (the Services).

Gemteq is committed to ensuring the privacy of your personal information. This document has been compiled with reference to the Commonwealth Privacy Act (1988) (Act) and the ten National Privacy Principles contained within that Act. It explains how Gemteq will collect, use and disclose your personal information.

Collection of Your Personal Information

Your personal information may be collected by GEMTEQ from time to time for its own use and in connection with providing you with the Services. Generally, the type of information we collect about you is the information included in your job application or resume. The type of information collected may include (but is not limited to):

  • personal details including full name, date of birth, address and other contact details;
  • emergency contact details;
  • information about termination or terms and conditions of your current and/or any previous employment;
  • training, performance, conduct or disciplinary records, including performance reviews from either your current and/or any previous employers;
  • remuneration details and bonus and share plan information of your current and/or any previous employment;
  • information about membership of a professional or trade association or a trade union;
  • annual, long service, sick, personal, parental or other leave records from your current and/or any previous employment;
  • taxation, banking and superannuation information;
  • health information; and
  • any other information provided by you.

Generally, we collect your personal information to facilitate the provision of the Services.

There may be occasions when we obtain personal information about you from a third party, such as when we contact your nominated referees or when receiving the results of a psychological or competency test.

Sensitive Information

Some personal information we collect and hold is 'sensitive'. Sensitive information relates to a person's racial or ethnic origin, membership of political bodies, religions or trade unions, professional or trade associations, sexual preferences or activities, criminal record, state of health and medical history. Sometimes, the provision of the Services will require the collection of sensitive information. We will only collect this type of information with your express consent.

However, if you do not provide us with the information we seek, we may be limited in our ability to provide you with our services.

Use and Disclosure of Your Personal Information

We may use and disclose your personal information solely for the purpose for which it was collected, or we may use it for any related secondary purpose involved in providing the Services.

We may disclose your personal information to:

  • potential employers;
  • clients who may wish to engage your services as a contractor or temporary employee;
  • organisations that conduct competency or psychometric tests;
  • referees;
  • to IT service providers;
  • to courts, tribunals and regulatory authorities as agreed or as authorised by law;
  • depending on the circumstances, to the Australian Federal Police to verify your criminal record; and
  • to anyone you authorise.

Accuracy of Your Personal Information

Gemteq aims to ensure that your personal information is accurate, complete and up-to-date. We realise that this information changes frequently with changes of address and other personal circumstances. It is your responsibility to advise Gemteq of any such changes.

Security of Your Personal Information

Gemteq will take all reasonable precautions to protect your personal information from loss, misuse or alteration.

Gemteq stores your personal information a combination of secure computer storage facilities and paper based files and other records.

In the event that you transmit any personal information using the Gemteq website, Gemteq will take all reasonable steps to protect that personal information. However, Gemteq cannot guarantee the security of such information because data transmissions over the Internet are never totally secure.

Access to Your Personal Information

You may request access to personal information held by Gemteq about you and advise Gemteq of any perceived inaccuracy.

To make a request, you will need to complete an application form verifying your identity and specifying what information you require. In providing the information, Gemteq may charge you a fee that will reflect our reasonable administrative, postage and handling costs.

The Act does set out some situations where you will not be able to access your information. For more information on circumstances in which you may not be able to access personal information you should go to the website of the Federal Privacy Commissioner at www.privacy.gov.au.
